Purpose:

To seek the Cabinet Member’s approval for Derbyshire County Council to enter a Section 8 Agreement with Derby City Council, under the Highways Act 1980, pertaining to the realignment, construction, and future maintenance of Snelsmoor Lane and proposed additional roundabout.

Decision:

That the Cabinet Member approves for Derbyshire County Council to enter an agreement with Derby City Council under Section 8 Agreement of  the Highways Act 1980, pertaining to the realignment, construction, and future maintenance of Snelsmoor Lane, Derby and proposed additional roundabout.

Reasons for the decision:

Completion of the arrangements under the terms of the agreement will enable the site works to proceed and complete effectively.

 

Alternative options considered:

Option 1: The council may wish to consider conducting the proposed works within their respective boundaries. However, it is considered that this approach would be impractical in terms of coordination, likely resulting in increased costs and disturbances. This approach could be considered unnecessarily obstructive and would contravene strategic objectives aimed at facilitating growth and development. In nearly all instances of this nature, one authority delegates their powers to the other. Typically, the authority with the majority of the works within their boundary is the one to whom powers are dedicated.

 

Option 2: The council could refuse to proceed with the works, however, this would contravene a consented position by the authority at the planning and would likely be an untenable position.
